§ 1 Scope and provider

(1) These General Terms and Conditions apply to all contracts concluded between ClearEdge Safety GmbH, Königsallee 24, 40212 Düsseldorf, Germany, registered at the Local Court Düsseldorf under HRB 98412 (hereinafter "we" or "ClearEdge Safety") and our customers via our online shop at clearedgesafety.com.

(2) Consumers within the meaning of these terms are natural persons who conclude a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB). Businesses are natural or legal persons or partnerships with legal capacity who, when concluding the contract, act in the exercise of their trade, business or profession (§ 14 BGB).

(3) Deviating terms of the customer do not apply unless we have expressly agreed to them in writing.

§ 2 Conclusion of contract

(1) The presentation of products in our online shop does not constitute a legally binding offer but an invitation to place an order.

(2) By clicking the button "Place order" (or a similarly labelled button) the customer submits a binding offer to purchase the goods in the shopping cart. Before submitting the order the customer can review and correct their entries at any time.

(3) We confirm receipt of the order by email (order confirmation). This confirmation does not yet constitute acceptance. The contract is concluded when we accept the offer by dispatching the goods and notifying the customer of dispatch, or by an express declaration of acceptance.

(4) The contract text is stored by us. The customer receives the order data and these terms by email and can view past orders in their customer account. The contract language is English.

§ 3 Prices and payment

(1) All prices shown in the shop are gross prices in euros (EUR) and include the statutory German value added tax (currently 19 %). Shipping costs are not included in the product price ("plus shipping") and are displayed separately before the order is submitted.

(2) The following payment methods are available: payment by credit or debit card (via Stripe), PayPal and, where offered, bank transfer in advance. We reserve the right to exclude individual payment methods in individual cases.

(3) For payment in advance by bank transfer, the purchase price is due immediately upon conclusion of the contract. We will reserve the goods for 7 days; if payment has not been received after this period, we may withdraw from the contract.

(4) If the customer is in default of payment, we may charge default interest at the statutory rate. For businesses the statutory rate is nine percentage points above the base rate.

§ 4 Delivery and shipping

(1) Delivery is made to the delivery address specified by the customer. Shipping costs and delivery times are set out in our Shipping & Returns information, which forms part of these terms.

(2) If goods are not available, we will inform the customer without delay and refund any payments already made. Partial deliveries are permitted where reasonable for the customer.

(3) For businesses, the risk of accidental loss or deterioration passes to the customer upon handover of the goods to the carrier. For consumers, the statutory rules of § 475 (2) BGB apply.

§ 5 Retention of title

The goods remain our property until the purchase price has been paid in full. Against businesses we retain title until all claims arising from the ongoing business relationship have been settled.

§ 6 Right of withdrawal

Consumers have a statutory right of withdrawal. Details are set out in our Right of Withdrawal information (Widerrufsbelehrung).

§ 7 Statutory warranty (Mängelhaftung)

(1) The statutory warranty rules apply. The limitation period for claims for defects is two years from delivery of the goods to consumers and one year to businesses. For used goods sold to consumers, the period is one year.

(2) Statutory rights of recourse are unaffected. Defects should be reported to us without delay at support@clearedgesafety.com, stating the order number, if possible with photos. Businesses must comply with their duty to inspect goods and give notice of defects under § 377 HGB.

(3) Any manufacturer's guarantees are stated separately on the product page or in the product documentation. They do not restrict statutory warranty rights.

§ 8 Personal protective equipment: proper use

(1) All personal protective equipment (PPE) offered by us complies with Regulation (EU) 2016/425 and carries the CE marking. The manufacturer's instructions for use and the marked protection classes and standards (for example EN 388, EN ISO 20345, EN 397) must be observed.

(2) The customer is responsible for assessing which protective equipment is suitable for the intended use and the hazards at the workplace. We are happy to advise you in the selection. Protective equipment must be inspected before each use and replaced if damaged, worn or past its service life.

§ 9 Liability

(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and to the extent we have assumed a guarantee.

(2) In case of slightly negligent breach of an essential contractual obligation (an obligation whose fulfilment is essential for the proper performance of the contract and on whose observance the customer may regularly rely), our liability is limited to the foreseeable damage typical for this type of contract. In other cases of slight negligence we are not liable.

(3) The above limitations also apply to the personal liability of our employees, representatives and vicarious agents.

§ 10 Vouchers

Discount codes and vouchers can only be redeemed in our online shop, only once per order and only within the stated validity period. They cannot be combined with other discount campaigns unless expressly stated, and they are not redeemable for cash.

§ 11 Data protection

Information on the processing of personal data can be found in our Privacy Policy.

§ 12 Applicable law and jurisdiction

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only to the extent that the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence is not withdrawn.

(2) If the customer is a business, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from the contractual relationship is Düsseldorf.

§ 13 Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. The European Commission's online dispute resolution platform was discontinued on 20 July 2025.

§ 14 Severability

Should individual provisions of these terms be or become invalid, the validity of the remaining provisions is unaffected. The statutory provisions apply in place of the invalid provision.
